First Charge Under Section 10(3)(B) Of The Whistleblower Protection Act 2020 (Act 711)

THE Malaysian Anti-Corruption Commission (MACC) has received consent from the Attorney-General’s Chambers to charge a senior company officer at the Kuala Lumpur Sessions Court at 8.30AM tomorrow.

The accused will face a charge under Section 10(3)(b) of the Whistleblower Protection Act 2010 (Act 711) for causing the dismissal of a company employee following whistleblowing to MACC on wrongdoing committed by the accused. The charge under this section is the first in history since the act came into force in 2010.

MACC is highly concerned about the problems faced by whistleblowers where actions are taken against them due to their disclosure of corruption committed by certain parties. The provisions of this law encourage whistleblowing on any kinds of corruption and wrongdoing, besides affording protection to whistleblowers from any detrimental action.

Therefore, MACC will not hesitate to investigate parties who attempt to cause detrimental action on whistleblowers. MACC hopes that the charge on this case would send a message to the public that they need not fear to cooperate with enforcement agencies to channel information on corruption and abuse of power.

This case is also hoped to serve as a lesson to those who attempt to take action on whistleblowers.
